Acceptable Use Policy
This Acceptable Use Policy (the "AUP") sets out the rules that govern your use of the EasyMark platform and related services (the "Service"), provided by SZTek Inc., doing business as EasyMark ("SZTek", "EasyMark", "we", or "us"). It supplements, and is incorporated into, our Terms of Service. By using the Service, you agree to comply with this AUP and to ensure that every user, employee, contractor, agency client, or end-customer who accesses the Service through your account also complies with it. Capitalized terms not defined here have the meaning given in the Terms of Service.
1. Your Responsibilities
You are solely responsible for the conduct of every person who accesses the Service through your account, for the lawfulness and accuracy of all Customer Content you upload or generate, and for every action the Service takes on connected channels at your direction or based on your configuration. You will: (a) keep credentials secure; (b) supervise users on your account; (c) configure approval gates appropriate to your risk tolerance; and (d) review AI Output before it is published or transmitted under your name.
2. Prohibited Content
You will not upload, generate, store, transmit, publish, advertise, or otherwise process content through the Service that:
- is unlawful, defamatory, obscene, or harassing, or that promotes violence, terrorism, or self-harm;
- sexually exploits minors, or depicts a minor in any sexual or sexualized context;
- incites hatred, discrimination, or violence against any person or group based on a protected characteristic;
- infringes a copyright, trademark, patent, trade secret, publicity right, privacy right, or other intellectual or proprietary right of any person, including by impersonating real persons or copying protected creative works;
- contains malware, ransomware, spyware, exploits, or any code intended to harm or disrupt systems or to gain unauthorized access;
- discloses personal information of another person without lawful basis, including doxxing, non-consensual intimate imagery, or sensitive identifiers (e.g., SIN, banking, health) outside an authorized use case;
- is fraudulent, deceptive, misleading, or designed to manipulate consumers, voters, or markets, including disinformation about elections, public health, or safety;
- concerns the buying, selling, advertising, or facilitation of regulated, illegal, or restricted goods or services where such activity is prohibited by law or by a connected third-party platform (including controlled substances, firearms or ammunition where prohibited, counterfeit goods, stolen property, or unlicensed financial or healthcare services);
- uses generative AI to create or distribute "deepfakes" of identifiable real persons without their consent, or to create non-consensual sexual imagery of any person;
- uses AI to mimic the likeness, voice, or persona of any real person in a manner that could deceive a reasonable consumer or violate publicity or privacy rights;
- violates the policies, terms, or community standards of any connected third-party platform (e.g., Meta, Google, LinkedIn, X, TikTok, Pinterest, YouTube, Stripe).
3. Prohibited Conduct
You will not use the Service to:
- send spam or any commercial electronic message in violation of Canada's Anti-Spam Legislation (CASL), the U.S. CAN-SPAM Act, the Telephone Consumer Protection Act, or any other applicable anti-spam, telemarketing, or unsolicited-communication law;
- send marketing email or SMS without the prior consent required by the law of the recipient's jurisdiction or without a working unsubscribe mechanism;
- collect, scrape, or harvest contact information from any source without lawful basis, or import contact lists obtained through purchase, scraping, or other illicit means;
- engage in fraudulent advertising, click-fraud, conversion-fraud, fake-engagement, follower-buying, review manipulation, or any practice that misrepresents the nature, source, or performance of marketing activity;
- impersonate any person, business, brand, or platform, or misrepresent your affiliation with any of them;
- conduct phishing, credential harvesting, business-email-compromise, or social engineering;
- circumvent, disable, or interfere with security, authentication, rate-limiting, audit, or content-moderation features of the Service;
- probe, scan, penetrate, load-test, or attempt to discover vulnerabilities in the Service without our prior written authorization;
- use automated means (bots, scrapers, crawlers, headless browsers) to access the Service except via documented APIs and within the published rate limits;
- resell, sub-license, or provide the Service to a third party except under a written reseller or white-label agreement with SZTek;
- use the Service to develop, train, or evaluate a product that competes with EasyMark, or to extract benchmark data for such a purpose;
- use the Service in any sanctioned country, or by any sanctioned person or entity, in violation of Canadian or applicable export-control or sanctions laws;
- use the Service to operate a bureau or service offering that grants access to third parties beyond the scope of your plan or workspace allotment.
4. AI-Specific Rules
Generative AI used through the Service is powerful and can be misused. In addition to the rules above, you will not use AI features to:
- generate child sexual abuse material or any content sexualizing minors, regardless of style or fictional framing;
- generate or distribute synthetic media that depicts a real, identifiable person engaging in conduct they did not engage in, without consent;
- produce content that materially threatens public safety, public health, election integrity, or the integrity of financial markets;
- generate code, instructions, or operational details for the creation of weapons of mass destruction, biological or chemical agents, or attacks on critical infrastructure;
- generate professional advice (medical, legal, financial, accounting) that you present to consumers without appropriate disclaimers, professional review, or licensing;
- strip, remove, or obscure provenance, watermarking, or AI-disclosure markers required by law or by the platform you publish to.
5. Channel and Platform Compliance
When the Service publishes content, runs ads, sends emails, or takes other actions on connected third-party platforms at your direction, you remain responsible for complying with the policies of those platforms. The Service's automation does not relieve you of any platform-specific advertising standard, restricted-content rule, branded-content disclosure, or community guideline. We may suspend integrations to comply with platform demands or to protect our other customers.
6. Email, SMS, and Voice Marketing
If you use the Service to send commercial electronic messages, you are responsible for: (a) obtaining valid express or implied consent as required; (b) maintaining accurate sender identification; (c) including an unsubscribe mechanism that operates without cost or undue effort and is honoured promptly (within ten (10) business days for CASL, or sooner where required); (d) maintaining suppression lists and consent records; and (e) complying with the rules of any list-rental, lead-generation, or third-party data source from which contacts were obtained. You agree to indemnify SZTek for any complaint, fine, or claim arising from your messaging activities.
7. Security and System Integrity
You will not (and will not permit any person to) use the Service in a manner that interferes with or disrupts its operation or any connected systems, including by transmitting viruses, mounting denial-of-service attacks, attempting to gain unauthorized access, exceeding allotted resources, or placing unreasonable load on infrastructure. Suspected vulnerabilities may be reported confidentially to security@easymark.ca; we appreciate responsible disclosure.
8. Reporting Abuse
To report content or conduct that violates this AUP, or to report a security concern, write to abuse@easymark.ca or security@easymark.ca with sufficient detail to allow investigation. We will review reports in good faith but are not obligated to disclose the outcome to non-parties.
9. Enforcement
We may, at our sole discretion and without prior notice, take any of the following actions in response to an actual or suspected violation: (a) suspend or terminate access to part or all of the Service; (b) remove, hide, or refuse to publish content; (c) disable channel connections or AI integrations; (d) require remediation, attestations, or additional verification before restoration; (e) preserve content and metadata for legal or investigative purposes; (f) report suspected illegal activity to law-enforcement, regulators, or affected platforms; (g) cooperate with investigations and respond to lawful requests for information; (h) charge reasonable costs incurred to remediate violations; and (i) pursue any other remedy available at law or under the Agreement. Restoration after suspension is at our discretion.
10. Survival and Updates
The obligations in this AUP survive termination of your account in respect of conduct occurring during the term and any liability arising from it. We may update this AUP from time to time as the Service, the legal landscape, and our risk profile evolve; the update process described in the Terms of Service applies.
